Pingintau.id – Jaksa Agung Muda Tindak Pidana Umum (JAM Pidum), Fadil Zumhana, kembali menyetujui enam permohonan penghentian penuntutan perkara berdasarkan keadilan restoratif atau restorative justice karena berdasarkan pertimbangan kemanusiaan.
Dalam keterangan yang diterima InfoPublik, Senin (30/1/2023), Kepala Pusat Penerangan Hukum Kejaksaan Agung, Ketut Sumedana, menyatakan alasan penghentian penuntutan berdasarkan keadilan restoratif itu diberikan antara lain, para tersangka baru pertama kali melakukan perbuatan pidana/belum pernah dihukum dan ini menjadi pertimbangan.
Ancaman pidana denda atau penjara tidak lebih dari lima tahun. Kemudian telah dilaksanakan proses perdamaian di mana tersangka telah meminta maaf dan korban sudah memberikan permohonan maaf.
Tersangka juga telah berjanji tidak akan lagi mengulangi perbuatannya. Proses perdamaian pun dilakukan secara sukarela, dengan musyawarah untuk mufakat, tanpa tekanan, paksaan dan intimidasi.
Selanjutnya, tersangka dan korban setuju untuk tidak melanjutkan permasalahan ke persidangan karena tidak akan membawa manfaat yang lebih besar. Termasuk pertimbangan sosiologis, dan masyarakat merespon positif.
Adapun enam berkas perkara yang dihentikan yakni:
1. Tersangka Dika Arrozak alias Dika dari Kejaksaan Negeri Tebing Tinggi Deli yang disangka melanggar Pasal 372 KUHP tentang Penggelapan atau Pasal 378 KUHP tentang Penipuan.
2. Tersangka Hendra Tadarus als Hendra bin alm Bachtiar dari Kejaksaan Negeri Aceh Tenggara yang disangka melanggar Pasal 44 Ayat (1) Undang-Undang RI Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga.
3. Tersangka Asmaini alias Semaini binti Eman dari Kejaksaan Negeri Gayo Lues yang disangka melanggar Pasal 351 Ayat (1) KUHP tentang Penganiayaan.
4. Tersangka Kasri alias Sri dari Kejaksaan Negeri Jakarta Selatan yang disangka melanggar Pasal 44 Ayat (1) Undang-Undang RI Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga atau Pasal 76C jo. Pasal 80 Undang-Undang RI Nomor 35 Tahun 2014 tentang Perubahan atas Undang-Undang RI Nomor 23 Tahun 2002 tentang Perlindungan Anak sebagaimana telah diubah dengan Undang-Undang RI Nomor 17 Tahun 2016 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang (Perppu) RI Nomor 1 Tahun 2016 tentang Perubahan Kedua atas Undang-Undang RI Nomor 23 Tahun 2002 tentang Perlindungan Anak menjadi Undang-Undang atau Pasal 351 Ayat (1) KUHP tentang Penganiayaan.
5. Tersangka I Anastasia dan tersangka II Fitri Tompinit dari Kejaksaan Negeri Jakarta Selatan yang disangka melanggar Pasal 351 Ayat (1) jo. Pasal 55 Ayat (1) ke-1 KUHP (yang dibuktikan) atau Pasal 170 Ayat (1) KUHP tentang Penganiayaan.
6. Tersangka Togu Manahan Poltak Siagian dari Kejaksaan Negeri Tanjungpinang yang disangka melanggar Pasal 44 Ayat (1) jo. Pasal 5 huruf a Undang-Undang RI Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga atau Pasal 80 Ayat (1) jo. Pasal 76C Undang-Undang RI Nomor 35 Tahun 2014 tentang Perubahan Undang-Undang RI Nomor 23 Tahun 2002 tentang Perlindungan Anak.
Selanjutnya, JAM Pidum memerintahkan kepada Kepala Kejaksaan Negeri untuk menerbitkan Surat Ketetapan Penghentian Penuntutan (SKP2) berdasarkan keadilan restoratif.
Hal ini berdasarkan Peraturan Jaksa Agung Nomor 15 Tahun 2020 dan Surat Edaran JAM Pidum Nomor: 01/E/EJP/02/2022 tanggal 10 Februari 2022 tentang Pelaksanaan Penghentian Penuntutan Berdasarkan Keadilan Restoratif sebagai perwujudan kepastian hukum.InfoPublik (***)
